But consider second-order effects. If Congress explicitly bans 'sports prediction markets,' Polymarket could be targeted as facilitating illegal gambling. Its decentralized structure makes enforcement difficult, but not impossible. The DOJ could target developers or sequencers. Even a chilling effect would drive away institutional liquidity. The real contrarian insight: Kalshi's best play is to ally with casinos. They could jointly lobby for a federal framework that legalizes sports prediction markets under strict rules – effectively turning Kalshi into a regulated sportsbook. That would legitimize the sector but crush decentralized competitors who cannot afford compliance. Yields die where liquidity dries up. If Kalshi survives by compromising, the entire sector's thesis changes. Watch for two signals next quarter: CFTC's formal response and Kalshi's hiring of lobbyists. If they hire a heavyweight like Covington & Burling, they plan to fight. If they quietly delist sports contracts, they retreat. The next 60 days will determine the trajectory.
